Fiona Rodgers,  Senior Associate at Penningtons Manches

Profile

Fiona is a senior associate in the commercial, IP and IT team in London. She specialises in non-contentious intellectual property, IT and commercial law, including branding and trade mark issues, IP protection, copyright and software licensing, and consumer law issues.

As an experienced IP and commercial lawyer, she advises on a broad range of commercial agreements, including terms and conditions of business, agency, distribution and supply agreements, consultancy agreements, collaboration agreements and IP and software licensing agreements. In addition, Fiona advises on trade mark opposition matters before the UK and European Union Intellectual Property Offices and has recently assisted on the successful defence to an EU opposition that was appealed to the Board of Appeal and the General Court.

She acts for clients in a variety of sectors including technology and education and has particular expertise in the data/advanced analytics sector, having spent 18 months on secondment with an international consultancy firm. She also works with a number of higher education providers, advising on compliance with consumer law, the CMA guidelines and Office for Students registration.

Fiona qualified in 2007 and joined the firm in 2011. Prior to embarking on a legal career, she worked for GlaxoSmithKline after completing her Master of Science degree in Chemistry at University College London. She is a member of the Society for Computers and Law and the intellectual property sub-groups of Multilaw and the European Law Group.

Recent work highlights

  • Advising and managing an international consumer product manufacturer’s trade mark portfolio to include prosecuting UK trade mark applications, co-ordinating international applications and successfully defending trade mark oppositions against third parties.
  • Acting for UK drug discovery companies in relation to drafting, reviewing and negotiating agreements, with a heavy focus on intellectual property rights (both background and foreground).
  • Advising a private fashion college on its terms and conditions for overseas students to ensure compliance with HTS Tier 4 Home Office guidance and consumer protection laws.
  • Drafting an e-learning agreement for a client that offers various in-house and online educational courses relating to payroll and human resources.
  • Advising a social enterprise company on its group licensing structure - including drafting assignments and database rights, trade mark registrations and licences for the use of the intellectual property rights.
