Emma Davies, Senior Associate at Penningtons Manches


Emma read Jurisprudence at Hertford College, Oxford, and trained at the firm, joining the commercial dispute resolution department on qualification in 2003. Her dispute resolution work includes breach of contract and professional negligence cases. She is currently advising a number of clients regarding swaps litigation. She specialises in regulatory compliance matters, including data protection, health and safety/fire safety compliance, property-related disability discrimination and environmental law. She advises clients facing data subject access requests, investigations and interventions from their regulator, and also represents clients in related civil disputes, whether resolved through mediation or litigation. 

She is known for her practical approach and for successfully liaising with regulatory bodies such as the HSE and Environment Agency on behalf of clients. She is keen that clients are able to keep up with the changing regulatory landscape and regularly provides lectures and seminars on these issues. She is a member of the UK Environmental Lawyers' Association and the Health and Safety Lawyers' Association.

Emma also deals with a variety of licensing issues for pubs and clubs, off-licences, public schools, universities and sporting institutions and is herself a Personal Licence Holder.

Recent work highlights

  • Designing and implementing a licensing strategy for a large university with five major campuses.
  • Defending a manufacturing client in a prosecution brought by the HSE concerning an employee injured at work.
  • Assisting a 40+ strong action group to campaign against mis-sold interest rate swap products, including representation in a Judicial Review challenging the FCA.
  • Advising a major scientific institution regarding the disposal of waste generated during experiments, and successfully preventing a prosecution being brought.
  • Assisting with a successful breach of contract claim against DCLG in the Commercial Court, distinguishing debt from damages for the purposes of claiming interest (E-Nik Limited v The Department for Communities and Local Government [2012] EWHC 3027).
