Development and infrastructure expertise

At Penningtons Manches Cooper, we are involved with projects from the outset and work with clients to shape their procurement (including public procurement) and contracting strategies. We negotiate and draft all forms of project, development and construction documentation. Our lawyers strive to ensure certainty of cost and delivery, and should it be necessary, assist in pre-empting and resolving disputes.

Distinguished by our specialist expertise, particularly in the accommodation sector, our team excels in advising on large-scale developments, complex regeneration projects, and joint ventures. We have helped shape various pathfinder development structures and currently act for several large development entities. Our work also includes a range of infrastructure projects in the UK and overseas.

We help clients to prepare agreements that best reflect their interests and the appropriate placing of risk. These may be based on standard form contracts (such as the NEC and JCT forms) or on bespoke agreements, tailored to meet a project’s requirements, including collaborative working arrangements and partnerships. They range from project specific contracts to multi-party and multiphase agreements used across most major construction sectors.

Building safety remains a significant part of our practice, with frequent instructions on fire safety, structural defects and Building Regulations compliance. We support clients on building remediation under the Developer’s Remediation Contract and the Building and Cladding Safety schemes.

Our lawyers bring strong experience in renewable energy projects, including solar schemes, microgrids and waste to energy initiatives.

Our support includes advising on early practical steps to help get schemes back on track and, where necessary, enforcing contract rights and security to bring projects successfully to completion.

Procurement and development strategy

Advising Cornall Council and Treveth on the establishment of various vehicles to deliver their £600 million investment and housing development programmes. This already includes 170 properties and 48 commercial units spanning 10 sites.

Adjudication in road tunnel project

Representing the project company for a new road tunnel in a large adjudication relating to the effects of Covid-19. In addition to conducting an adjudication with the employer, we dealt with the construction joint venture and its related claim.

Housing investment and scheme recovery

Acting on the purchase of 580 energy-efficient homes in Walthamstow. We advised on protecting our client’s interests, enforcing security and appointing a new entity to complete the works when the developer and contractor entered administration.

Central London green office upgrade

Acting on the acquisition and refurbishment of 88,000 sq ft of prime, green-fund-approved offices in central London. We negotiated full construction documentation, with enhanced environmental compliance and funder reporting, including security, appointments and key contracts.

Nuclear facility contractual scope dispute

Advising on a scope of work dispute at a nuclear power station, involving conflicting contractual schedules related to large transformers. We supported the contractor in securing agreement from the employer on entitlement and value.

Building Safety Scheme dispute resolution

Representing institutional investors in claims against housebuilders over structural and fire safety issues, including applications under the Building Safety and Cladding Safety Schemes. We negotiated and implemented agreements to investigate and carry out remedial works.
