Hilary is a partner in the employment team. She has over 25 years’ experience across a broad range of contentious and non-contentious employment work. This includes all forms of employment litigation in the High Court and tribunals, while she also advises on cases such as terminations, redundancies, all aspects of discrimination and whistleblowing legislation, TUPE and other contractual issues.

In addition, Hilary is particularly recognised for her expertise on academic and higher education disputes, as well as her work for senior employees, academics and partners, especially on high-profile and high-value disputes. She has co-ordinated a number of wide-scale restructurings in different businesses, as well as advising on industrial relations issues across businesses from international and FTSE 100 companies through to SME and not-for-profit organisations, including, in particular, higher and further education institutions, colleges and schools. She also undertakes litigation on restrictive covenants and team moves. Increasingly, Hilary advises on matters with a regulatory cross-over involving the Charity Commission, Office for Students, and Information Commissioner’s Office, and other administrative bodies.

As well as advising clients in a wide range of educational and charity institutions, Hilary has responsibility for clients in technology, including life sciences. She has developed particular expertise in data protection and privacy and, increasingly, the use of artificial intelligence as it applies to both employees and student matters.

Redundancy programme

Advising a major life sciences company on a redundancy programme across several sites, which included managing a change in the terms and conditions for the remainder of the workforce.

Atypical workers’ rights

Advising on the status of numerous academic and atypical workers in higher education, including on their rights as atypical workers, fixed term workers, and under relevant university statutes.

Discrimination and whistleblowing claims

Acting for a well-known charity to defend a number of discrimination and whistleblowing detriment claims, including advice on how best to protect the reputation of the charity, both in general, but also during any public hearings.

Breach of fiduciary duty

Acting for a senior executive on the termination of his appointment, including defending claims for breach of fiduciary duty and confidence, ultimately achieving a very significant settlement.

Freedom of information

Advising a number of higher education clients on the use of personal data and freedom of information requests as part of tactics in litigation.

Financial fraud accusations

Advising a non-conflicted group of directors in a not-for-profit organization on the HR process to follow when board members were accused of financial fraud by whistleblowing members of staff.
