Online trading: key compliance requirements

In the current climate, the UK Government is encouraging online retail. The closure of many stores, restaurants and other outlets means that online trading is significantly on the increase, as is the use of online learning platforms and other tools.

Businesses trading online need to take care that they comply with the formalities required for online contracting, and respect consumer rights. These requirements include ensuring that prices are displayed in a transparent manner and that the point at which a customer enters into a legally binding contract is clear. There are also mandatory requirements to provide certain information on a website. In addition, the use of cookies for any website must be assessed to ensure that the appropriate consents are obtained in accordance with legal requirements.

Data protection compliance will need to be considered, including ensuring that the website privacy notice is up to date. A further consideration is how to effectively and compliantly carry out digital marketing.
