Residential possession proceedings to allow redevelopment


A group of institutional investors engaged us to secure vacant possession of some residential flats above a large block of commercial and retail premises on a well-known London high street.

We served notices and recovered possession from eight residential tenants. Most of the other residential flats were vacant, and the presence of remaining tenants affected the client’s ability to deal with the premises. Some tenants had protected or assured tenancies.

The final residential tenant vacated by way of negotiated settlement, following the issue of possession proceedings on grounds of an offer of suitable alternative accommodation. Obtaining vacant possession has allowed the client to sell long leases for the upper floors of retail units for redevelopment by adding floors and constructing luxury flats.
