Default costs certificate defended in Employment Tribunal claim

We were instructed by the defendant in the matter of Willis v Harthills (2024) EWHC 409 (SCCO) to recover costs that had arisen from an Employment Tribunal claim.

At the conclusion of the matter, a bill of costs was served totalling £294,143.85. Following this, no points of dispute were received, and so a default costs certificate was obtained.

The claimant subsequently made an application to set aside the default costs certificate, which was opposed by our costs team. At a contested hearing before Costs Judge Leonard, it was held that the default costs certificate had been correctly obtained, and that the application to set aside the certificate would fail.

As a result, judgment was entered in full for the full amount of the bill, together with the costs of the application hearing.
