James Severn

Partner

James is a partner in the shipping group and a member of the marine casualty response team. Since joining the firm in 2006, he has dealt with the full range of personal injury and fatality claims, and has particular expertise in accidents on ships and in ports.

Specialising in the marine sector, James is often instructed by shipowners and their insurers to attend vessels to undertake immediate post-accident investigations, as well as the investigations by the MCA, MAIB, HSE and the police. He advises ship owners and their insurers in respect of both criminal prosecutions and civil claims, as well as allegations of sexual assault on ships. In addition, James advises on industrial disease claims, with particular experience in claims arising from alleged exposure to asbestos. He has expertise in the passenger sector and advises numerous cruise and ferry operators in respect of their liability to passengers under the Athens Convention and the Passenger Travel Regulations. James also advises clients in respect of salvage, towage and offshore contracts.

I enjoy the multi-sector nature of my work. I am an expert in marine personal injury and passenger shipping and advise clients of both civil and criminal issues. I also advise clients in the sports sector with a particular focus on football and motor sports.

A member of the British Association for Sport and Law, James is recognised by the Legal 500 in both shipping and sports law. His sports practice focusses on football and motor sports. He advises players, clubs and agents on disputes, transfers, contract negotiations and disciplinary issues. James has significant experience of claims before the FA, FIFA and the CAS and advises on regulatory and disciplinary issues in motor sports. He is a member of the England Boxing Disciplinary and Safeguarding Panels. James is also a member of the firm’s responsible business committee, and leads engagement with the UK Chamber of Shipping’s sustainable practices working group.

Advising ship managers on a criminal prosecution by the MCA from trial arising from a fatal collision at sea, as well as connected civil proceedings in various jurisdictions.

Passenger ship collision

Acting for owners and insurers in respect of a serious collision leading to loss of life, advising on the regulatory and criminal investigations, the collision claim and the subsequent civil proceedings.

Serious cruise injury

Advising on a multi-million pound personal injury claim following a serious accident on a cruise ship. The claim included complex expert evidence in various medical fields.

Football agent dispute

Representing an international agent in a dispute with a top-flight professional footballer in an FA Rule K arbitration.

Salvage

Being instructed by the salvor in the immediate aftermath of a salvage on LOF terms, and advising on security and settlements with ship and cargo.

Crew claims

Acting for a ferry operator following a very serious accident on a vessel operating in the offshore sector, advising on interesting jurisdictional issues as well as the significant underlying claim.
