Senior associate

Gemma is a senior associate in the employment team who services clients nationally and regularly acts for claimants, including the Police Federation and its members. An experienced employment litigator, she specialises in both contentious and non-contentious employment matters involving complex discrimination, victimisation and whistleblowing claims.

Additionally, Gemma pursues claims in the civil courts for protection from harassment, misfeasance, unlawful arrests, statutory debt claims and other claims under the Police Regulations. Her work portfolio includes a number of test cases which are likely to have wider membership interests in the policing arena. She also challenges decisions of police authorities through the process judicial review.

Gemma prides herself on getting the best results for her clients and has negotiated a number of settlement packages including financial and non-financial elements. She is recognised in the Legal 500 as a ‘Recommended Lawyer’. Gemma is a member of the Employment Lawyers Association and the firm’s CSR committee. She qualified as a fellow of the Chartered Institute of Legal Executives in 2016, joined Penningtons Manches Cooper in 2020 and subsequently has become dual qualified as a solicitor. She has previously worked both in-house and for a leading regional law firm.

Disability discrimination claim

Representing a neurodiverse police officer in a disability discrimination claim with the tribunal unanimously finding in favour of the officer on all heads of claim, including direct disability discrimination (Lauren Crawford vs The Chief Constable of Cumbria Constabulary).

Direct race discrimination claim

Acting for a group of officers in a direct race discrimination claim, claiming positive discrimination with a tribunal unanimously finding in favour of the claimants (Turner-Robson & Others vs The Chief Constable of Thames Valley Police).

Group test claim

Leading a group test claim for indirect sex discrimination for officers with colour vision deficiency who were either removed from taser duties or not allowed to apply to be a taser operative due to their colour vision deficiency.

Test cases for officers

Leading on a number of test cases for officers in relation to the requirements of the Job-Related Fitness Test and whether these amount to age, disability or sex discrimination.

Unfair dismissal

Acting for an officer in a discriminatory constructive unfair dismissal claim based on alleged disability discriminatory treatment which led to her resignation.

Injury award

Successfully securing an injury award for a gratuity and an injury pension under the Police Injury Benefit Regulations for an officer who contracted Covid while on duty which led to them being ill-health retired.
