David O’Brien

David is a partner in the commercial dispute resolution team, specialising in high-value, complex commercial disputes, with a particular focus on financial product claims, professional liability claims,  insurance litigation and commercial contract disputes.

His practice includes litigation in the Commercial Court, Chancery Division of the High Court and arbitration, as well as dispute avoidance advisory work and strategic advice aimed at risk mitigation for companies. Much of his work has an international focus and involves multi-jurisdictional parties and proceedings.

I enjoy complex litigation, particularly the challenge of getting good results for clients in difficult circumstances. Foresight and careful long-term strategy are important elements in successful litigation and play a big role in safeguarding clients’ interests and optimising their results.

David is also experienced in handling complicated, multi-party actions and leads the firm’s growing group actions team. His specialisms in this field include multi-party claims relating to financial and property investment schemes as well as bringing and defending multi-party claims under insurance policies.

David is known for his technical and strategic legal ‘nous’ and his ability to develop practical solutions to achieve results for clients. He is ranked in Chambers UK as a leading individual for professional negligence and group litigation and in the Legal 500 for commercial litigation and group litigation.

Acting in a £21 million insurance coverage dispute relating to the alleged dishonesty of an insured and operation of the dishonesty exclusion clause in the policy.

Representing a large number of investors to claim losses of £7 million suffered in relation to failed care home investment schemes.
