Bethan Carr

Senior associate

Bethan is a senior associate in the Guildford family team who advises on all areas of private family law, including divorce, financial remedy proceedings, private children disputes and cohabitation issues. She regularly assists with the negotiation of voluntary financial settlements, while also supporting her clients with court proceedings, where necessary.

She has a particular specialism in modern family law, including domestic and international surrogacy arrangements and frequently advises intended parents on their path to parenthood and assists them in respect of their legal status. Bethan’s approach is to find a solution which works best for her clients’ individual situation and she has been described as ‘thorough, professional and knowledgeable’.

Where a relationship has broken down, my role is to provide clear advice tailored to my clients’ individual situations and to assist them in making an informed choice about their options. I understand the sensitivities associated with family building and aim to provide a responsive service to support my clients throughout their journey.

Described by a peer as having ‘an encyclopaedic knowledge of surrogacy’, she has written about surrogacy for a number of publications, including The American Bar Association’s The SciTech Lawyer, The Times, Glamour Magazine and Resolution’s The Review magazine, and is often asked to speak about surrogacy at events and conferences. Bethan is a member of Resolution, the leading specialist family law solicitors’ organisation, and currently sits on Resolution’s Children Committee. She was shortlisted in the 2021 Lexis Nexis Family Law Awards, Family Law Young Solicitor of the Year category, and was nominated for Surrogacy Professional of the Year in the National Surrogacy Awards 2022.

Representing intended parents in the High Court and obtaining a parental order for them following the birth of their child through a surrogacy arrangement in the US.

Internal relocation

Advising a same sex legal parent in respect of her prospective internal relocation application.

Guidance for intended parents

Advising intended parents considering surrogacy and providing guidance on their options in the UK and overseas.

Successful appeal

Representing a mother in her appeal against an enforcement finding against her before the President of the Family Division, with the appeal being allowed and the finding, previous order and costs order being set aside.

Cross-border dispute

Representing a mother alongside international solicitors in respect of her relocation to England, her English divorce and financial proceedings, and private Children Act proceedings.
