Medical negligence specialists contribute to AvMA’s Lawyers Service Newsletter

Medical negligence and personal injury partner, Philippa Luscombe, and associate, Victoria Johnson, have contributed two articles to the November 2025 issue of AvMA’s (Action against Medical Accidents) Lawyers Service Newsletter.

AvMA is a registered charity in England, Wales, and Scotland that campaigns for patient safety and justice, supporting those who have been harmed by medical accidents. Its newsletter provides those handling medical negligence claims with the latest information on the most important developments, changes and trends in the field.

Philippa Luscombe’s article, titled ‘Clinical negligence in the NHS and lessons not learned’, takes a look at the rising number of medical negligence claims taking place year on year, making use of Solomonic – a litigation analytics platform – to assess which NHS trusts are responsible for the most litigated claims. She argues that trusts should look to move away from reactive litigation management, towards more proactive care improvement, in order to help deal with these rising figures.

Victoria Johnson, meanwhile, in her article ‘Birth injury and the psychological impact on families: what the law can do’, explores the emotional impact that a severe brain injury at birth can have on a family, and the scope for psychiatric support within legal claims for medical negligence – something which can, sadly, be limited.
