The personal injury team at Penningtons Manches LLP has settled a claim against a driver for a client who suffered injury after being knocked over whilst crossing the road.
The claimant was injured when the driver turned into a side road without checking if it was safe to do so. The driver had to swerve to avoid one pedestrian and, in the process, struck the claimant. He was lifted onto the bonnet before coming to rest on the road side. The driver initially tried to dispute responsibility but following receipt of the police accident report, liability was admitted. After obtaining expert evidence, Penningtons Manches successfully negotiated a settlement of the claim.
William Broadbent, an associate in the personal injury team, dealt with the case. He commented: “We are handling a range of cases involving collisions with cars and pedestrians and it is clear from the number of reports of such accidents that this is an increasing problem. Fortunately, in this instance, the car was travelling at a relatively low speed and our client was able to react before impact. Otherwise, his injuries may have been much more serious.”
