The personal injury team at Penningtons Manches LLP has recently settled a claim for damages against a driver for a client who suffered injury after being knocked from his bicycle.
The claimant was injured when the driver effectively undertook him as he approached a junction. While preparing to take a right turn, the defendant turned right across his path. The car hit the bicycle and he was knocked to the ground sustaining a number of injuries. The driver initially denied responsibility but, after investigation and analysis of the evidence, we were satisfied that the driver would be held to be at fault for the accident. We issued court proceedings against him and shortly afterwards his insurers agreed to negotiate a settlement.
William Broadbent, an associate in the personal injury team, dealt with this case. He commented: “We are dealing with a number of cases involving collisions between cars and cyclists and it is clear from the media that this is an increasing problem. The pattern here of a driver who probably didn’t see the cyclist until too late and then sought to provide an explanation that exonerated him from blame is familiar. In this case, it is lucky that the impact was not at high speed otherwise our client’s injuries would have been much worse”.
