Penningtons Manches wins damages for death of mother-to-be and her unborn child as a result of delayed treatment

John Kyriacou, of the clinical negligence team at Penningtons Manches LLP, has settled a claim for damages against Surrey & Sussex Healthcare NHS Trust for the death of a mother-to-be and her unborn child. The mother-to-be developed an infection which was left undiagnosed and untreated, resulting in intrauterine death. A further delay occurred with the removal of the unborn child, resulting in the mother developing septic shock. This was before another delay, this time in administering appropriate anti-biotics, resulted in the tragic death of the mother.

The claim was brought on behalf of the husband. Despite the catalogue of errors, liability was initially not admitted so we issued court proceedings against the trust, following which a settlement was reached.
