Same day settlements secure significant damages for clinical negligence claimants

Penningtons Manches LLP's clinical negligence team in Godalming finalised a range of settlements on contested matters within the space of a few hours on 5 December 2013. The total damages achieved for the four clients in these cases exceeded £110,000.

Senior associate Emma McCheyne settled two claims, one of which was listed for a three day High Court trial in February, and Lucie Prothero and Naomi Holland each settled a case.

The claims related to varying aspects of medicine:

  • the failure to appropriately identify and repair a tear to a client's uterus during the course of a caesarean section, resulting in an unnecessary hysterectomy and therefore preventing her from having any more children;
  • the late diagnosis of a tumour in the sigmoid colon causing unnecessary pain and suffering;
  • an accidental significant surgical laceration during surgery leaving an unsightly cleavage scar, compounding an already difficult situation for a breast cancer patient;
  • the delay in diagnosis and treatment of a postpartum haemorrhage resulting in a client suffering dizziness causing her to collapse and to sustain a fracture to her ankle.

The varied nature of the cases reflects the clinical negligence team's breadth of experience in this field.
