Ministry of Justice amendment set to benefit clinical negligence claimants

The Ministry of Justice has recently confirmed an amendment to the Legal Aid, Sentencing and Punishment of Offenders Act (LASPO) which will allow after the event premiums for expert reports to be recovered from the defendant in clinical negligence cases where a claimant wins their case.

Whilet it was expected that this exception would be made, the confirmation is good news as disbursements (expert report fees etc) in clinical negligence cases can be very costly and a lack of insurance protection would have been likely to deny many people the chance to investigate their claim.
