Our elderly client tripped over a defective and broken paving stone when walking along a busy high street. She fell forwards landing on her dominant right arm and sustained a nasty fracture and a shoulder injury.
There was initially some dispute in identifying the relevant defendant as the location was on the boundary between public and private property. However, the local council was deemed to be responsible for the location and it accepted that it had failed in its obligation to maintain the area so that it did not present a hazard to the general public.
The case settled for £17,500.
