Protecting a private college from foreign students' non-compliance with visa requirements

Our client, a private college offering professional studies, was aware that several of its students were not complying with their visa requirements and called in Penningtons to advise on its contractual agreements and tighten up the terms and conditions for future student contracts.

The immigration, commercial and dispute resolution teams worked together to provide an integrated solution that included advising on UK Border Agency compliance matters and contractual arrangements with students; and amending its terms and conditions for students to provide future protection. While this was a substantial piece of work, our client regarded it as a damage limitation exercise to protect its HTS status and its ability to issue CAS to foreign students to enable them to apply for Tier 4 student visas.
