Injured holidaymaker in Kenya wins claim against Kuoni Travel for garden accident


We pursued a claim against Kuoni Travel Limited following an accident involving our client while she was on a package holiday in Kenya.

While in the hotel garden, our client tripped and fell into a concealed gulley which was approximately 20cm wide and 10cm deep. She fell heavily onto her right-hand side fracturing her right hip. She required an operation in hospital where the fracture was secured by internal fixation. She also sustained an injury to her right knee which aggravated a previous condition and accelerated the onset of the symptoms of osteoarthritis. The injuries were so debilitating that she had to move house.

We issued proceedings in the UK citing the Package Travel Regulations. Kuoni subsequently brought in the hotel as an extra defendant together with a further third party who was believed to be the owner/operator of the hotel.

Shortly before trial, we received an offer of £65,000 plus reasonable legal costs which was accepted in full and final settlement of the claim.
