Disputed road death resolved through inquest
We acted on behalf of the family of a man in his 30s who was tragically killed by a car when crossing the road as a pedestrian. The driver of the vehicle involved denied responsibility, and his insurers disputed liability, alleging that the deceased had walked out in front of the car without warning, leaving the driver with no opportunity to avoid the collision.
We supported the family throughout the inquest, where we were able to play an active role in examining the available evidence. In particular, we questioned a key eyewitness and brought to light important details surrounding the circumstances of the collision. These clarifications had a significant bearing on the assessment of the events in question: subsequently the coroner made findings of fact which supported the family’s position.
Following the inquest, and in light of the coroner’s conclusions, we were able to secure an admission of liability from the driver’s insurers. This was a crucial step in ensuring the family received the compensation they deserved.
