Our client was born prematurely, after 30 weeks, and suffered cerebral palsy and associated physical and mental disabilities. He requires daily care for life.
The premature birth was caused by a contraceptive device that had been identified during the first trimester of the pregnancy, but negligently left in place. A registrar at the hospital the mother was attending for her antenatal care did not properly advise the mother's GP of the risks of not removing the contraception and, as a result, the mother was not aware of the increased risk of premature birth and its potential consequences, which sadly materialised in this case.
