Thomas Kirby

Senior associate

Thomas is a senior associate in the commercial, IP and IT team. He advises on technology and data protection matters, having assisted clients with IT agreements, intellectual property and technology licensing, and general commercial contracts.

He regularly assists clients to conduct data protection audits, implement data protection policies and documents and respond to data breaches. In addition, Thomas is experienced in advising on all aspects of ‘soft’ intellectual property protection and enforcement. This includes a particular emphasis on protecting, managing and enforcing trade marks both internationally and in the UK through registry actions and litigation.

I am a technology lawyer who can assist clients with protecting, defending and exploiting their intellectual property rights. I also help clients to navigate their compliance with data protection laws by providing commercial solutions, with a particular interest in cross-border transfers of personal data.

Working with clients across a broad range of sectors, Thomas is experienced in advising a range of technology companies including providers of artificial intelligence, data analytics, and computer software and hardware. He has also worked on a virtual secondment with a social media company. Thomas joined Penningtons Manches Cooper in 2020, having previously qualified at and worked for another leading UK law firm.

Data protection audit

Performing a data protection compliance audit for an international pensions organization, conducting a gap analysis and advising on data sharing, vendor agreements, internal policies, consent issues and international data transfers.

Power supply agreement

Drafting an agreement for a manufacturing client for a temporary power supply and negotiating with the landlord, which included complex issues around monitoring and payment structures, liability and termination.

Trade mark dispute

Acting for a client in UKIPO opposition proceedings where both parties had longstanding use, and negotiating an agreement which enables the client to continue to use and register its trade mark.

AI terms of use

Drafting standard terms of use for a provider of AI software in the aviation industry, which included navigating tricky issues on ownership of intellectual property rights in the output.
