Sarah is a partner in the contentious private client team, advising on private wealth disputes. She is also an accredited civil and commercial mediator accepting instructions to mediate probate and trust matters at all stages of a dispute.

She specialises in all issues surrounding a death, a trust or elderly persons. This includes bringing and defending 1975 Act claims, claims by and against trustees and executors, will validity, property ownership, tax and financial disputes. Sarah also brings claims against professionals in the context of private client advice. She regularly acts as independent trustee or administrator in disputed trusts and estates, helping to move on administrations and get parties out of deadlock. Her approach is to use inter-party negotiation where possible, and court guidance and authority where needed.

I help navigate clients through complex and difficult litigation which is often exacerbated by family relationships and history. I focus on resolving disputes, finding neat and workable solutions to minimise future conflict, and allowing people to move on.

Negotiating the structure of a complex estate distribution agreed property and shareholding buy-outs to keep the family home in ownership and the family businesses running following a death.

Independent trustee

Acting as independent trustee pursuant to a court appointment. Enabled a family trust to be managed and distributed following a dispute between beneficiaries.

Post-death variation to estate

Successfully obtaining court approval on behalf of minor children to a post-death variation of an estate, enabling the family to take advantage of significant tax benefits and set up trusts for their inheritance.

Rectification of trust error

Successfully obtaining court rectification of an error in a trust document to remedy the mistake, and claimed full recovery of the legal costs against negligent solicitor.

Grants of administration

Obtaining grants of administration in difficult family set-ups following unexpected deaths, including missing family members, children under residential and guardianship orders.

Order for repatriation

Obtaining a successful injunction and order for repatriation of a deceased person’s body to the US for burial in the contested case of Morigi & Others v Murphy.
