Michael is a partner and head of the contentious private client team. Highly regarded by clients and peers, he specialises in domestic and international trust and estate disputes including disputed wills, breach of trust claims, administration of estate disputes, and claims under the Inheritance (Provision for Family and Dependants) Act 1975.

He advises on contentious applications in the Court of Protection, succession planning and acting for charities, and has also represented clients in numerous mediations and arbitrations – as well as reported cases – in getting their disputes resolved. He regularly gives evidence as an expert witness in court proceedings outside the UK. Michael also acts as a trustee and is appointed as an administrator of estates by the court.

My job is to help clients through disputes involving trusts, estate and capacity issues, and to achieve resolution through negotiation and litigation, when needed. As this can be a really difficult time for a family, I always strive to get the best possible outcome for my client.

Securing estate assets

Advising on an estate where the deceased had an Indian domicile, identifying assets held within the estate and advising on securing those assets for the estate.

Court approval

Obtaining court approval for steps being taken by trustees in the course of administration. Appointed administrator by the court to administer contested estate.

Collecting estate assets

Acting for a deputy in identifying and collecting in the assets belonging to the estate, obtaining directions from the Court of Protection, and obtaining a statutory will.

Validity of will claims

Advising on the validity of will claim, a claim under the Inheritance (Provision for Family and Dependants) Act 1975, and a third-party claim against the estate.

Adult child claim

Acting for an adult child who was making a claim under the Inheritance (Provision for Family and Dependants) Act 1975, and defending a claim in another estate brought by the widow under the same act.

Removal of an executor

Successfully applying to the court on behalf of a charity for the removal of an executor and recovering misappropriations from the executor.

Advising on the devolution of assets located in Switzerland and successfully applying for recognition of an English grant.
