Senior associate (Avocat)

Franck is an avocat in the Paris office who has extensive experience of most aspects of transport law as well as commercial disputes, civil procedure and real estate law. His expertise also extends to consumer and bankruptcy law.

Pragmatic and persistent, Franck is experienced in cases that are sometimes sensitive for clients and is able to achieve amicable resolutions through negotiation. His clients include freight forwarders, road carriers, logistics companies and small and medium-sized businesses in diverse areas of the economy such as real estate agents, property dealers and retailers.

In contentious cases, where the parties are sometimes aggressive towards each other, which can then lead a solicitor to take on their client’s anger, I aim, through genuine listening and a dialogue that is both technical and constructive, to find amicable solutions that are ultimately beneficial to clients.

Franck started his legal career at Richards Butler then set up and ran his own law firm for almost 15 years before joining the judiciary as a trainee judge. Following two law degrees at the University Paul Cezanne of Aix-en-Provence and Paris 2 Panthéon-Assas respectively, Franck qualified as an avocat in the Paris bar in 2002 and is currently registered with the Rouen bar. As a member of the Propeller Club of the United States in Rouen, Franck has also worked for various maritime interests.

He joined Penningtons Manches Cooper as a senior fee earner in 2019. He speaks both French – his mother tongue – and English and has lectured at Université de Rouen-Normandie for 15 years.

Civil liability ruling

Obtaining a civil judgment ruling that the Public Prosecutor’s Office’s decision not to prosecute a criminal offence does not mean that this offence cannot be considered a fault, giving rise to civil liability.

Appeal court success

Acting on a case where the court ruled a global logistics services contract cannot in any way derogate from public policy provisions governing international road transport, thereby limiting compensation to the provisions of said provisions.

Free sea trip compensation

Assisting with a case which determined that without the involvement of a third party in an accident, the compensation limit resulting from the individual accident cover included in the liability insurance contract applies, leaving the balance of the compensation for victims to the ship’s captain.
