Partner

Binder is a partner in the employment team. He advises on a broad range of contentious and non-contentious employment and partnership matters, and is recognised, in particular, for his expertise in complex discrimination claims, class actions, collective labour and trade union law.

He has been involved in a number of test cases over his career, spanning from worker status and employment protections to industrial action, and in both the Supreme Court and the European Court of Human Rights. Binder is experienced in all forms of employment litigation, both in the High Court and tribunals, as well as discrimination (in employment and partnership), regulatory issues and industrial action injunctions. He works for a wide range of staff associations and their members and, in addition, acts for senior employees and partners, frequently in relation to discrimination claims.

I view my job as one that requires me to apply my understanding of the dynamic between an employer and a worker in any particular sector or situation, and explain and apply both the law and practical insight to help the client to achieve a meaningful resolution to workplace issues.

Binder qualified in 1995 and joined Penningtons Manches Cooper in 2017 from another leading City law firm, where he was a partner for over 16 years. He is a past treasurer of the Employment Lawyers Association and is a frequent speaker within the profession and to clients. Binder is a regular media commentator on employment issues, and is the editor of the Tolley’s chapters on industrial action and trade unions.

Recent work highlights

Class action for public sector workers

Advising and leading on a claim for 40,000 public sector workers, challenging the transitional provisions and lack of protection for their pensions following 2015 reforms in a group claim of age discrimination.

Industrial action matter and related dismissals

Advising on a protracted national industrial dispute and subsequent claims involving 200 employees complaining of unfair dismissal and detriments short of dismissal following the industrial dispute.

Religion and belief discrimination

Advising and acting in a complex case of workplace religion and belief discrimination and the balancing of such rights when considering individuals’ rights to free speech.
