Tony Burns

Tony is a very experienced real estate lawyer who worked with a City firm for many years before joining Penningtons. He is a specialist in industrial development work and acts for a number of property companies and developers who acquire, develop and manage industrial sites. He also acts for owner occupiers in both the office and leisure sectors.

In addition to development work, Tony deals with all aspects of commercial property including investment portfolio acquisitions and disposals, and commercial leases, acting for both the landlord and tenant. He also advises on deal structures to enable the acquisition and subsequent development and disposal of sites, including overage arrangements.

Tony deals with energy related transactions such as leases and sales of power stations, and energy from waste plants, and related documentation. He also has experience of data centres, having recently negotiated an option agreement over a significant site for the construction of a major data centre. His sector expertise extends to marine related property work, having dealt with a number of foreshore and pontoon leases for marine clients.

Recent work highlights

Acquisition, letting and sale

Acting for the landowner / developer in connection with the site acquisition, ten lettings, and related construction work of a prime industrial site in Southampton together with the subsequent sale of the asset to a fund for circa £43 million.

Development funding agreement

Advising the landowner / developer on a funding agreement for the development of a large industrial unit in Liverpool, subject to planning, to include grant of long sub lease to the fund, and subsequent construction of the building under the funding agreement. Total consideration approximately £7.5 million.

Energy from waste plant

Acting for the landowner on the lease of land in Birmingham with the benefit of planning permission for an energy from waste plant at a substantial rent, and all related documentation including option and lease of related carbon capture storage plant.

Data Centre

Advising the developer on taking an option over a complicated site for a long lease of a data centre, subject to conditions including planning and enabling works, as well as BNG, environmental issues, and dealing with existing tenants. Total value of the scheme was c£150m.
