Noel McMichael, Partner at Penningtons Manches


Noel is a consultant in the commercial dispute resolution team specialising in the resolution of business-related disputes across a wide range including corporate with a particular emphasis on shareholder and corporate governance issues, partnership, banking and insolvency related issues, advising directors, officeholders and lenders, as well as commercial contracts, passing off, trade mark and copyright  issues and professional negligence.

He qualified in 1979 and joined the firm as a partner in 1990. He is experienced in giving 'positioning' advice to assist in the early resolution of commercial and other disputes. Noel has acted as a client representative in a number of mediations.

He also works closely with the immigration and education teams to provide clients with integrated solutions to their problems. Noel has extensive experience of drafting a wide variety of agreements, particularly in the context of professional firms. He is a member of the Association of Partnership Practitioners.

Recent work highlights

  • Advising London Metropolitan University on its challenge to the UKBA’s decision to revoke its Highly Trusted Sponsor status resulting in LMU being granted interim relief and permission to apply for a full judicial review.
  • Resolving the potentially damaging outcomes of a university’s problems with an overseas collaboration partner and their potential risk to its sponsor status.
  • Acting for a hedge fund management company and trying to resolve a dispute with a former employee to avoid a very substantial claim arising out of an executive share incentive scheme.
