Profile

David has over 25 years of experience in real estate litigation, acting for owners and users of commercial and residential property as well as for housing associations. His work includes advising on commercial landlord and tenant disputes; easements; rights to light; party wall disputes; the construction of leases, including provisions for breaking leases; and developing roof spaces.

He also provides advice on residential property management, including enfranchisement and lease extensions, service charge disputes and beneficial ownership claims. He is involved in claims before the courts and the Property Chamber (First-tier and the Upper Tribunal).

David is a member of the Property Litigation Association, the Pyramus and Thisbe Club and the Association of Leasehold Enfranchisement Practitioners. He has also been recognised by Chambers UK and the latest edition of The Legal 500.

Recent work highlights

  • Advising a commercial tenant on its obligations for repair of its shop units involving a claim to the High Court for damages following the collapse of the façade of the building.
  • Acting for a shopping centre tenant on its claim for damages in relation to loss of security of tenure when its rights of lease renewal were not protected.
  • Securing a settlement of a dispute over the validity of a tenant client’s break notice served in respect of its leasehold HQ, which was surplus to its requirements.
  • Advising leaseholders on an application to the Property Chamber First-tier Tribunal for the appointment of a manager where the leaseholders were in deadlock over the management of their building.
  • Representing an intermediate landlord on a successful application to the First-tier Tribunal for the determination of reasonableness of charges payable by leaseholders - some of which included charges passed on by a superior landlord, who the team joined to the claim.
