From Awaab’s Law to leasehold reform: a legal update

Damp and mould – Awaab’s Law – guidance for social housing landlords

Following the tragic death of Awaab Ishak, the Social Housing Regulation Act was enacted and it included provisions to bring into effect what the government has called ‘Awaab’s Law’, to force social landlords to fix damp and mould within strict time limits. The government launched a consultation on Awaab’s Law in order to determine how long a landlord should be given to deal with hazards. The outcome of the consultation is awaited. What is clear is when the guidelines are eventually announced, social landlords will need to keep very meticulous records of their investigations into defects and be able to justify decisions made regarding works and temporary accommodation.

Sara Stephens, associate director in the real estate litigation team, will outline what actions social landlords may want to consider to get ready for the implementation of Awaab’s Law.

Leasehold reform update – The Leasehold and Freehold Reform Act 2024
 
Charlotte Benson-Goring, a senior associate in our housing development team, will discuss the latest provisions relevant to leasehold acquisitions and ongoing management:

  • What’s included in the Act?
  • Majority ban on leasehold houses
  • Increased transparency of service charges
  • Redress scheme for leaseholders to enable them to more easily challenge poor performance of freeholders who directly manage a building
  • Maximum time limits for the provision of information by freeholders on sales
  • Changes to rent charges rules

Commonhold – what’s next for commonhold in residential transactions?
