Successful challenge to Traffic Commissioner’s procedural decision

The Traffic Commissioner had refused to agree a request by our client, a small dairy business, to grant an adjournment of a public inquiry.

We advised our client to challenge this procedural decision by judicial review and were successful – the first time that this had happened. The Traffic Commissioner’s ruling was overturned following the judicial review application resulting in costs being ordered against the Traffic Commissioner.
