Resolving a network charging dispute on behalf of a generator


We have successfully acted for a generator in a network charging dispute. With an in-depth knowledge of the relevant regulations, we advised on potential grounds for a regulatory challenge to the relevant network charging methodology and on the procedural and practical issues involved.

Our knowledge of the electricity generation and distribution network markets, combined with our commercial law acumen and civil dispute resolution skills, led us to identify grounds for potential commercial law claims based on breach of contract and tort.

We advised our client on a strategy for leveraging these potential regulatory and commercial law challenges in order to reach a negotiated commercial resolution of the dispute. We worked with third party economic consultants to advise the client, and successfully achieved an outcome that remedied the issues with the charging methodology as it applied to our client’s plant.
